Introduction

At Blue Lab Co., Ltd., when collecting, managing, and using personal information as part of our business operations, we shall handle this information according to these guidelines.


1. Compliance with laws concerning personal information.

We shall comply with Japan’s Act on the Protection of Personal Information and other related laws and regulations and these guidelines regarding the handling of personal information protection.


2. Acquiring personal information.

2-1 We shall only acquire personal information appropriately, never through false or other improper means.

2-2 We shall not acquire “Special Care-required Personal Information” (yohairyo-kojin-jyoho) as defined under Japanese law without obtaining the consent of the individual in advance, except in cases permitted under laws and ordinances.


3. Use of personal information.

3-1 We shall use personal information within the scope necessary for achieving the following business operations and purpose of use. Moreover, we will not use it for purposes other than the stipulated purpose of use. In the case of using personal information for business or purposes not stipulated below, we will only do so after obtaining the individual's consent in advance, except where permitted under laws and regulations including Japan’s Act on the Protection of Personal Information.

(5) Creating and selling a computer program

(6) All related operations to the business listed above

[2] Purpose of Use

(1) To provide information relating Blue Lab's business.

(2) To send replies or materials in response to inquiries.

(2) To provide information relating to Blue Lab's seminars, products, and other services.

(3) To conduct our business smoothly.

(4) To perform other business than above.

3-2 If we change the purpose of use of personal information, we will do so within the scope that it is reasonably acceptable to have relevance to the initial purpose of use. Also, if we change the purpose of use, we will announce the changed purpose by updating these guidelines, unless a different method is stipulated in laws such as the Act on the Protection of Personal Information.


4. Securing the accuracy of personal data

We shall keep personal data accurate and up-to-date within the scope necessary for achieving the stipulated purpose of use, and when we no longer need it, we shall erase such personal data immediately.


5. Security management of personal data

We shall take necessary and appropriate measures to prevent the leakage, loss or damage of personal data we have collected and any other necessary measures for ensuing personal data security management. In addition, when Blue Lab’s executive officers and employees (all persons engaged in our business, regardless of employment contract; hereinafter “Employees”) are provided with access to person data, to ensure the security management of that personal data, we shall conduct necessary and appropriate supervision of said Employees’ use of the personal data.


6. Consignment of personal data

In the case of consigning all or part of the handling of personal data to a third party, we will conduct a rigorous investigation on the third party, and to ensure the secure management of personal data entrusted to the third party, we shall supervise the third party as necessary and appropriate.


7. Provision of personal data to third parties

In principle, we shall not provide personal data to third parties without obtaining the individual's consent in advance, except in cases permitted under laws and regulations such as Japan’s Act on the Protection of Personal Information.


8. Retained Personal Data

8-1 We retain the following personal data.

(1) Files containing client names and information

(2) Electronic mail files received and sent

(3) Files containing contact information (Personal data of those who contacted us and those who have exchange business cards with us)

(4) Employee-related files (including “Specified Personal Information” (tokutei-kojin-jyoho) as defined under Japanese law)

8-2 The owner of the data is Blue Lab Co., Ltd.

8-3 The purpose of use of “Retained Personal Data” (hoyu-kojin-deta) as defined under Japanese law is the same as the purpose described in 3-1 above. However, for files containing Specified Personal Information, the purpose of use is limited to the scope of use stipulated under Article 9 of Japan’s Act on the Use of Numbers to Identify a Specific Individual in the Administrative Procedure and is collected for the purpose of submissions to public authorities as stipulated in Article 19-2 in this Act.


9. Disclosure/correction of personal information

9-1 If an individual requests that we disclose to them the data which we have collected on them, we shall disclose it promptly. However, in the cases listed below, we may not disclose all or part of Retained Personal Data.

(1) When there is a risk of such disclosure harming the life, body, property or other rights and interests of the individual or a third party.

(2) If there is a danger that such disclosure will significantly hinder our ability to appropriately operate our business.

(3) In cases where such disclosure would violate other laws or ordinances.

9-2 If there is an error in the content of personal data and there is a request for correction, addition or deletion (hereinafter "Corrections") from the individual to whom the data pertains, we shall respond to these requests promptly upon investigation. However, if as a result of this investigation, the personal data is deemed to be correct, or if we determine that Corrections are not necessary to achieve the stipulated purpose of use, we may not make Corrections.

9-3 If Blue Lab uses Retained Personal Data beyond the scope necessary for achieving the stipulated purpose of use, or acquires such data by false or other illegal means, or provides such data to a third party without the consent of the individual or a legitimate reason for doing so, then the individual may request suspension of use or deletion of such Retained Personal Data (hereinafter "Suspension of Use"). However, in cases where Suspension of Use would incur significant expense or is not feasible, we may take other measures rather than Suspension of Use.

9-4 Please follow the disclosure request procedures stipulated below in order to request Correction or Suspension of Use of Retained Personal Data. When submitting a request, you must include a form of personal identification (such as an original Certificate of Residence (juminhyo), or a copy of your driver’s license, passport, or health insurance card, or other forms of ID deemed acceptable by Blue Lab) that can prove that you are the individual whose data is being requested. Since the purpose of use of Retained Personal Data is disclosed in this policy, we shall not respond to individual requests regarding disclosure of the purpose of use.

Disclosure request procedures

To submit a request for the disclosure of Retained Personal Data, include a statement containing the items listed below and a self-addressed return envelope (the address on the envelope must be the same as that on the form of personal identification submitted). In the case of a request by proxy, you must also submit documentation to prove that the requestor is a legal representative of the individual whose personal data is being requested. Additionally, a fee of 1,000 yen in cash is required per request.

When submitting a disclosure request, please specify to the extent possible the type of personal information and the period of time when it was collected by Blue Lab. If requesting Correction, please specify the correct information, and if you are requesting a Suspension of Use, please state the reason.

11. Changes to this policy

The content of this policy is subject to change. After this policy has been changed, the new version shall take effect from the time of posting on this website, unless we specify otherwise.
